George Zimmerman did not face a grand jury.  In Florida, you don’t necessarily have to, unless the charge is first degree murder.  Special Prosecutor Angela Corey decided not to go there.

In Texas, you don’t get a choice.

In Texas, a prosecutor has to convince a grand jury there is enough evidence to pursue a case before it can go to trial.  Legal expert and Houston defense attorney Chris Tritico doesn’t think the case would ever gone beyond a grand jury, here. Further, he thinks that’s where the case should have ended.

Tritico says the prosecution either did not have, or did not present, the kind of evidence that would have gotten it a guilty verdict anywhere in Texas, or anywhere in the nation.

If you leave the facts exactly as they came in, yes, he would have been acquitted in Texas.  The prosecution just couldn’t meet its burden of proof, to prove beyond a reasonable doubt, that he intended to kill this kid.

Tritico says without that compelling evidence, you don’t have a murder…in Texas, or anywhere.
