Los Angeles Police Department Chief Charlie Beck recommended on Monday that criminal charges should be filed against an officer who shot a homeless man in the back and killed him last year, reports the Los Angeles Times. Officer Clifford Proctor is accused of shooting and killing Brendon Glenn after the man attempted to get himself off the ground while on his stomach.

The incident took place on May 5 of last year when Officer Proctor approached the 29-year-old Glenn. According to the Los Angeles Times and reported accounts, Glenn made no aggressive moves towards Proctor or his partner. Proctor’s partner also told authorities he wasn’t aware of why the officer stepped back to shoot Glenn.

Police records state that Proctor was responding to a 911 call that a person was harassing people near a row of restaurants and bars in Venice. The person in question happened to be Glenn, but video evidence of the interaction didn’t reveal if Glenn got physical in how it was initially reported.

CBS Los Angeles reported that Mayor Eric Garcetti issued a statement in support of Chief Beck’s recommendation to bring charges against Proctor.

“No one is above the law and whenever use-of-force crosses the line it is our obligation to make sure that principle is upheld. Our officers perform heroic work every day, work that often goes unheard, but accountability is fundamental to the trust that needs to exist between our officers and the people they serve. Maintaining that trust is essential to keeping our neighborhoods safe,” read part of the statement.

No official charges have been filed by the Los Angeles County District Attorney’s Office nor have they released any comments regarding the case.
