(GALVESTON, TX) — A federal jury was unable to decide if the City of Galveston should pay former Houston Astros pitcher Brandon Backe $13 million for a police beating back in 2008.

The jury concluded that Galveston police officers used excessive force during a post-wedding reception party at the San Luis Resort’s H2O bar on October 5, 2008; however, they were unable to reach a unanimous verdict on Backe’s pursuit of $13 million for injuries he suffered as a result of the beating.

Backe and 11 others brought suit against the city and 10 police officers, claiming they were beaten by police at the party after 30 officers stormed the hotel bar. The jury only found four of the officers liable and awarded the 12 victims $48,900. It’s a victory, but very little money will be left over after they split it up and pay legal fees.

Backe said the injuries he sustained ended his major league pitching career. He said he’ll seek another trial.
