(HOUSTON) – One of Houston’s most infamous killers has been released to a halfway house in Austin.

David Port is now in Austin after serving only 28 years of a 75 year prison sentence for killing mail carrier Debra Sue Schatz.

He will be fitted with a GPS monitor, and will be placed in sex offender treatment counseling to determine “if he is indeed a Sexual Predator and thus subject to the sex offender registry,” Andy Kahan, victim advocate for the City of Houston, said.

Port is also not permitted to enter Harris County, Kahan reports.

The 47-year old served enough time on good behavior to fulfill his 75 year sentence.

He was freed 30 years, almost to the day, after he forced Schatz by gunpoint to his home as she delivered mail in Port’s West Houston neighborhood, then shot her as she tried to leave.

Port will reside at Southern Corrections of Austin, 3154 East Highway 71, in Del Valle for an undermined amount of time.

Port was 17 at the time of the murder. Now 47, there are no strings attached, and he walked out of prison a free man thanks to a loophole in Texas law.

This loophole is opening the cell doors for hundreds of convicted killers and other violent criminals, setting dates for their early release.

All inmates convicted between 1977 and 1987 are being released from prison after the number of days they have spent in jail and the number of days they have spent in good conduct equals one-third of their initial sentence, according to the Texas parole guide.

“Under state law, he must be released June 5th,” Andy Kahan, victim advocate for the City of Houston, said.

Schatz was delivering mail to Port’s house the day she died, filling in for a co-worker who had called in sick.

Kahan believes Port first tried to rape her before shooting her. Now, he is trying to get Port classified as a sex offender.

“That’s the only way the community will know where he is residing,” Kahan said.
