A disturbing discovery in Montgomery County as deputies respond to a car stopped on Loop 494 in Porter.

It was 11 p.m. Wednesday night and it’s not clear why Jessica Gutierrez was stopped on the road. She admitted to deputies that she had had some beer and taken Prozac and Xanax.

Her sedan was full of belongings, but it was what was underneath some of the clutter that shocked deputies.

It was Gutierrez’s 8-month-old daughter in a car seat. That child was ok. Gutierrez failed a field sobriety test. She was taken to the Montgomery County Jail in Conroe. While being processed she did express concern for the child.

“Why can’t I get a hold of her dad so she can go to her cousin’s instead of going into the system?” she asked.

Deputies were even more concerned because even though the car was full of belongings, there were no diapers, baby clothes or milk for the 8-month-old. Child Protective Services will take custody of the child.

Gutierrez also told deputies she had a 12-year-old with a roommate, but could not remember the roommate’s name.

The 40-year-old is being held on $25,000 bond.
