(CONROE, TX) — A 19-year-old Conroe man was arrested for last week’s slaying of a Montgomery County convenience store owner, and a younger person of interest was also in custody.

Montgomery County Sheriff’s Office deputies said Joseph Gutierrez was charged Friday for the capital murder of Sam Sadruddin, also known as “Mr. Sam.”

A 13-year-old boy is also a person of interest in the case. He could face a capital murder charge, but not the death penalty. Under law, the boy can’t be charged as an adult.

County Attorney J.D. Lambright says the boy faces a long prison term if convicted. The child appeared in court Monday, and prosecutors say he has an extensive history in the juvenile system.

According to KHOU 11′s legal analyst Gerald Treece, the most the 13-year-old could receive is a 40-year sentence.

Gutierrez is being held without bond at the Montgomery County Jail in Conroe. No charges have been filed against the boy.
